The January 2000 issue of the Federal Lawyer, (Vol. 47, No. 1) contains a book review authored by Charlie Faruki of Seventh Circuit Judge Richard A. Posner's book, "An Affair of State: The Investigation, Impeachment, and Trial of President Clinton." The book review appears at p. 51. Charlie concludes his book review by commenting on the special duty and responsibility of attorneys to promote confidence in the legal system.

Ann Wightman was named recently to the Board of Trustees of the Greater Dayton Volunteer Lawyers Project ("VLP"). Many FG&I attorneys provide pro bono services in southwest Ohio, for example, serving as arbitrators appointed by the Montgomery County Common Pleas Court, representing victims of domestic violence, and providing their time and financial support to VLP projects and cases.

FG&I's winning results continue in the new Millennium. On January 10, Chief Judge Walter H. Rice of the United States District Court for the Southern District of Ohio granted FG&I's motion for summary judgment in Hensley v. EG&G Mound Applied Technologies. The court ruled that FG&I's client EG&G was entitled to judgment without the necessity of a trial in a case in which a discharged employee alleged age discrimination, breach of contract, and promissory estoppel. In this opinion, Judge Rice disposed of the Plaintiff's claims of age discrimination in violation of federal and state laws, breach of implied contract, promissory estoppel, and intentional infliction of emotional distress. The 35-page opinion contains an extensive analysis of the law in these areas, including Ohio's law concerning at-will employment and the effects of employee handbooks on such issues.

Upcoming newsletters will provide detailed news of two other significant January, 2000 victories: 1) a favorable summary judgment ruling in an antitrust case handled by FG&I for longtime client, The Iams Company; and 2) in a widely-watched piece of Y2K litigation, the successful defeat of a motion for class certification in an action alleging Y2K compliance issues brought against FG&I client Reynolds & Reynolds.
