A private arbitration handled with great success by FG&I recently became public when the losing party filed suit in Hamilton County Common Pleas Court, in Cincinnati, to overturn the result, and the local business press reported on the case. Last year FG&I's client, Premier Health Partners (the operating company which runs Miami Valley Hospital and Good Samaritan Hospital in Dayton) filed an arbitration demand against Catholic Health Initiatives ("CHI"), which brought counterclaims. Together with Premier's General Counsel, FG&I's Charlie Faruki and Jeff Sharkey tried the case last summer. The panel of three Arbitrators found in Premier's favor on almost all issues. For relief, the Arbitrators' ruling included an order that CHI issue $60 million in bonds that CHI had declined to issue, the proceeds of which are to be used for construction of capital improvements to the two Dayton hospitals operated by Premier. Additional relief included $4.7 million in damages. As reported in the local business press, the matter has been settled, with the bonds being issued and the damages being paid, and CHI's state court lawsuit has been dismissed.

The April 14 issue of the Business News, the Dayton-area business newspaper, reported its annual survey of the largest Miami Valley law firms (ranked by number of full-time local attorneys). At one point number 19, FG&I has moved to fifth place in that survey. It is also the largest litigation practice in Dayton.

FG&I was featured in the April 14, 2000, Business News article, "Litigation Leaders." The article notes that the firm "has grown fast since its start by investing in people and technology and staying focused on what it does best." When asked for comment by the Business News, University of Dayton Associate Professor of Law Charles Hallinan had this to say:

"A commercial litigation firm is involved in bodies of law that are very complex. You have to have a mastery of those complexities to litigate and the Faruki firm is well known for that."
