FG&I Wins Appeal. FG&I attorneys Ann Wightman and Jeff Sharkey recently won an appeal on behalf of the firm's long-time client, Amcast Industrial Corporation ("Amcast"). Ann and Jeff successfully urged Ohio's Fourth District Court of Appeals to affirm the trial court's dismissal of Plaintiffs' "toxic tort" case against Amcast and others. At the trial court level, the Plaintiffs argued that they suffered continuing injuries because they lived very close to a landfill which -- they alleged -- constituted a continuing nuisance and hazard. The Court of Appeals affirmed, ruling that Plaintiffs' complaint was barred by the statute of limitations. Copies of FG&I's motion to dismiss, appeal brief and both court decisions are available upon request.
FG&I Continues to Be One of Dayton's Leading Law Firms. In the Dayton Business Journal's 2001 listing of Dayton's largest law firms, FG&I is listed Number 4, the same position it held in the 2000 rankings.

The firm sponsored a reception on May 10 honoring Dayton's leading businesses.
Mary Wiseman Wrapping Up Public Service Tenure. FG&I partner Mary Wiseman was the featured guest on WDTN's Dayton and Beyond television program in March. The broadcast focused on Mary's public service career, as she completes her term as a Dayton City Commissioner. In addition to her busy law practice and civic obligations, Mary is co-teaching an introductory course on intellectual property in the Legal Assistants Program at Sinclair Community College. Mary's portion of the course addresses substantive legal issues applicable to copyrights, trademarks, trade secrets and patents.
FG&I Wins Product Liability Suit Dismissal. On May 23, 2001, the Montgomery County Court of Common Pleas dismissed FG&I's client, Formtek, Inc., from a products liability lawsuit. FG&I argued the action was filed beyond the governing statute of limitations. (The litigation is continuing against other defendants in the case.)
Jeff Ireland a Featured Speaker at Ohio State Bar Association Convention . At the Ohio State Bar Association annual meeting in Dayton on May 9-11, 2001, Jeff Ireland moderated and spoke at a seminar entitled: "Current Hot Issues in Antitrust Proceedings." Jeff, a member of the Board of Governors of the Antitrust Section of the OSBA, coordinated the speakers and topics discussed. He spoke on the application of Daubert to economic testimony. Jeff's presentation, "Economic Testimony in the Post-Daubert World," covered challenges to economic testimony that have been offered in the courts as well as the ways that expert economic testimony can be protected from Daubert challenges. Jeff is a frequent speaker at CLE programs; his practice focuses primarily on antitrust, intellectual property and trade issues.
