Highlights

December

  • Faruki Ireland & Cox P.L.L. was one of the principal sponsors for the Dayton Business Journal's 2003 Business of the Year Awards Program.
  • FI&C partner Mary Wiseman was recognized as the December 2003 Barrister of the Month by the Dayton Bar Association in its monthly publication, Bar Briefs. 
  • Along with Montgomery County Common Pleas Judge Barbara Gorman, FI&C associates Julie Zink and John Fischer are serving as volunteer advisors to the mock trial team at Chaminade-Julienne Catholic High School in Dayton. 
  • FI&C was recently featured in a special profile "Outlook:  Dayton Business Profiles" in the November 10, 2003 edition of Forbes magazine. 
  • FI&C hosted a holiday reception for clients, Judges and friends on Thursday, December 18, 2003
  • FI&C has completed its fall 2003 recruiting season with offers to several outstanding law students.

November

  • On October 20, 2003, the United States Court of Appeals for the Sixth Circuit affirmed a grant of summary judgment in favor of FI&C client Western Trimming Corp. ("Westrim").
  • FI&C successfully obtained summary judgment in a large patent case on behalf of its client, a worldwide consumer products company.
  • FI&C congratulates all ten attorneys from the firm who passed the July 2003 Ohio Bar Examination, and who were sworn in as new members of the Ohio Bar on November 10, 2003.
  • On November 5, 2003, the Supreme Court of Ohio declined jurisdiction and dismissed the appeal of a plaintiff attempting to bring a cause of action for intentional spoliation of evidence against an adverse expert witness based on the opinion testimony provided by the expert at a previous medical malpractice trial.

October

  • Charlie Faruki has been appointed as the 2003-2004 State Chair for Ohio, for the American College of Trial Lawyers
  • In a Decision and Entry filed October 9, 2003, Chief Judge Walter H. Rice in U.S. District Court in Dayton granted a Motion for Preliminary Injunction in the DPL Inc. Securities litigation
  • Jeff Cox gave two CLE seminars in Dayton on October 10, 2003 for the National Business Institute, entitled "Practical Legal Ethics in Ohio -- Issues and Answers."
  • FI&C associate Ron Raether's article entitled "E-mail Maelstrom -- Electronic documents must be managed,"
  • Charlie Faruki, Jeff Ireland, and Jeff Cox joined 250 other federal court practitioners and members of the federal judiciary at the 2003 Federal Bench-Bar Conference

September

  • The Dayton Business Journal's September 12, 2003 edition features the annual list of Dayton's largest law firms
  • Charlie Faruki, Jeff Ireland, and Jeff Cox received notification this month that they were selected as Ohio Super Lawyers for 2004
  • FI&C, and one of the firm's long-time clients, The Iams Company, were proud co-sponsors of the opening meeting for the 2003-2004 program year of the I-Zone, Dayton's business and technology incubator
  • FI&C has begun its Fall 2003 recruiting initiative, conducting on-campus interviews at the following schools...
  • On September 10, 2003 Judge Rose of the United States District Court for the Southern District of Ohio considered and granted the Motion to Dismiss or in the Alternative for Summary Judgment that was filed on behalf of our clients, Northrop Grumman Corporation and Litton Industries

August

  • The Dayton Business Journal conducted a survey of Dayton-area CEO's and other community leaders to identify the most influential people in the region. 
  • FI&C welcomes nine new associates this month, seven of whom are 2003 law school graduates. 
  • Mary Wiseman was a presenter this summer at a Dayton Bar Association CLE seminar on federal practice entitled "Federal Court for Dummies."
  • Dan Binegar gave a presentation on August 8, 2003 to twenty-four paralegals practicing in Dayton and Cincinnati. 

July

  • Charlie Faruki has been chosen to serve as the State Chair for Ohio of the American College of Trial Lawyers for the 2004-2005 biennium
  • Ohio's Second District Court of Appeals recently affirmed a decision by the Montgomery County Common Pleas Court dismissing a lawsuit brought against FI&C's client, a prominent physician, challenging adverse expert testimony given by the physician in an earlier wrongful death action
  • In his first patent infringement case, United States District Judge Thomas Rose of the Southern District of Ohio recently issued a claim construction ruling adopting in large measure the position advocated by FI&C attorneys Charlie Faruki, Tom Kraemer and Don Burton at the May 6, 2003 "Markman" hearing
  • Jeff Ireland gave a CLE presentation in June in Columbus at the Ohio State Bar Association's Conference for New Lawyers
  • Mary Wiseman and Charlie Faruki were featured speakers at the 2003 Ohio State Bar Association Convention held in Dayton in early May
  • FI&C is pleased to welcome three attorneys recently associating with the firm

May

  • In an action by a computer assisted research provider against a competitor in which Faruki Ireland & Cox represents the plaintiff, Chief Judge Rice in the United States District Court in Dayton recently rejected the Defendant's challenges
  • FI&C recently won an arbitration victory in proceedings before the American Arbitration Association in New York City
  • A new legal directory has been published, that it says is designed to reflect market opinion
  • Tim Pepper joined FI&C at the end of April.
  • At the Annual Convention of the Ohio State Bar Association, which was held in Dayton in May, Charlie Faruki and Mary Wiseman spoke at the Antitrust Compliance CLE Seminar

  • FI&C congratulates associates Charlie Bruch and Mary LeBoeuf on becoming members of the Ohio Bar

  • FI&C associate Ron Raether has been selected by the Dayton Business Journal as a 40 Under 40 award winner for 2003, and was recognized at the April 10, 2003 awards banquet as one of Dayton's emerging generation of new leaders
  • In a lengthy decision, Chief Judge Rice has rejected challenges to various Lanham Act claims
  • On April 4, 2003, FI&C played host to a delegation of eleven Russian lawyers visiting Dayton to learn more about the way American lawyers practice law and contribute to the academic, governmental and business institutions of the United States
  • Michele Murphy joined FI&C as an associate in April

March

  • In the DPL Inc. Securities Litigation pending before Chief Judge Walter Rice in U.S. District Court in Dayton, the firm's clients received a favorable ruling from the Court on their Motion to Stay Discovery in the state actions.
  • Caroline Gentry's article, "Preparing Today Will Pay Off Tomorrow:  Getting Clients Ready For Electronic Discovery,"
  • Tom Kraemer was a lecturer at the March 21 Licensing Intellectual Property Seminar
