In the DPL Inc. Securities Litigation pending before Chief Judge Walter Rice in U.S. District Court in Dayton, the firm's clients received a favorable ruling from the Court on their Motion to Stay Discovery in the state actions.  In the consolidated securities actions in federal court, the defendants moved for an order staying discovery in the four derivative actions pending in state court in Dayton and Cincinnati.  Charlie Faruki argued the motion for the defendants.  In a February 25, 2003 Decision, Chief Judge Rice granted the requested stay of discovery under the Securities Litigation Uniform Standards Act of 1998.  In what is apparently the first ruling in the Southern District of Ohio under that stay provision, the Court ruled that discovery in the state court derivative litigation would be stayed until the federal court has ruled upon a to-be-filed motion to dismiss the plaintiffs' federal securities claims.

Caroline Gentry's article, "Preparing Today Will Pay Off Tomorrow:  Getting Clients Ready For Electronic Discovery," was published in the February 2003 edition of IP Litigator magazine.  A 1995 graduate of Yale Law School, Caroline clerked two years for the Honorable Walter H. Rice, Chief Judge for the United States District Court for the Southern District of Ohio before joining FI&C in 1997.  Caroline co-chairs the Dayton Bar Association's Federal Practice Committee and recently joined the Board of Directors of Planned Parenthood for the Miami Valley.

Tom Kraemer was a lecturer at the March 21 Licensing Intellectual Property Seminar sponsored by the University of Dayton School of Law.  Tom's presentation focused on litigation of intellectual property licensing issues.  In addition to his busy practice at FI&C, Tom is an adjunct professor at UDSL, teaching appellate practice and an intellectual property trial practice course.

FI&C was one of the lead sponsors again in 2003 for the YWCA of Dayton's Women of Influence Recognition Luncheon held March 13.  The annual event recognizes leading women civic and community leaders of the greater Dayton community.  Diane Goderre is a member of the YWCA's Board of Directors.

Mary Wiseman, Suzanne Scheiner-Albl and Caroline Gentry were part of the teaching faculty for the Dayton Bar Association's February 2003 New Lawyer Seminar, a two-day training session which is a mandatory requirement for newly-admitted attorneys.

Mary LeBoeuf recently was named to the Associate Board of the Dayton Art Institute.  A 2002 graduate of the University of Dayton School of Law, Mary was a member of the University of Dayton Law Review and clerked for the Honorable Jeffrey Froelich of the Montgomery County, Ohio Common Pleas Court.

Lisa Parilo and John Fischer helped coach Dayton's Chaminade-Julienne Catholic High School Mock Trial Team to a second place finish at the February 2003 district competition, where several of the Chaminade-Julienne students won top oralist awards.  Lisa and John continue their work with the team in preparation for this month's state competition in Columbus and hope to assist the team beyond the state competition, pointing for the national event in New Orleans in May.

FI&C supports many family-focused philanthropies throughout the year, including Daybreak Runaway Shelter, the Artemis Center for Domestic Violence and the YMCA, among others.  Earlier this month FI&C was a corporate sponsor of the Big Brothers and Big Sisters Bowl-a-Thon event.  Several FI&C attorneys and staff members donated their own time and financial support of this event as well.
