FI&C achieved two important wins recently on behalf of its client, The Iams Company, a wholly-owned subsidiary of The Procter & Gamble Company, in Lanham Act litigation with a competitor. In a dispute that involves challenges to both parties' advertising, the United States District Court for the Southern District of Ohio ruled in Iams' favor on motions that excluded Iams' opponent's expert economist on Daubert grounds and then, on summary judgment, barred Iams' opponent from obtaining any monetary damages. Iams is represented by Jeff Ireland and Laura Sanom. Iams' opponent has asked for reconsideration of the ruling.
Jeff Ireland, Laura Sanom and Don Burton recently won a multi-day preliminary injunction fight in the U.S. District Court for the Southern District of Ohio on behalf of the firm's client, Crown Equipment Corporation, in a dispute with a Florida lift truck dealer and a competing manufacturer. After a four-day evidentiary hearing, the court denied the dealer's request for a preliminary injunction, and the parties now move to arbitration proceedings as called for under the dealer agreement.
FI&C associate Keith O'Korn has accepted a position as a career law clerk to The Honorable John Hoffman, United States Bankruptcy Judge for the Southern District of Ohio in Columbus. Prior to joining FI&C, Keith was law clerk to The Honorable George Limbert, United States District Judge for the Northern District of Ohio. Everyone at FI&C wishes Keith a long and successful career in his new position with Judge Hoffman.
