On May 17, a number of partners and associates in the firm made a presentation to one of the firm's clients, on the two subjects of Daubert hearings and Markman hearings. The audience for the presentation was a client's in-house law department, including its general counsel and many lawyers involved in intellectual property matters and litigation. The portion of the program concerning Daubert hearings dealt with the practicalities of challenging an expert's testimony as unreliable under the U.S. Supreme Court's Daubert ruling and its progeny; the program included a demonstration of the cross-examination of an expert witness and a successful Daubert challenge. The Markman component of the presentation included a mini-Markman hearing, at which the FI&C attorneys demonstrated the arguments over claim construction of a patent, including the testimony of an expert witness.
Charlie Faruki received the Dean Francis J. Conte Special Service Award from the Alumni Association Board of Trustees of the University of Dayton School of Law. Although Charlie is not a graduate of the University of Dayton School of Law, the Special Service Award was presented in recognition of his "distinguished service to the Community and to the University of Dayton School of Law." Charlie serves on the Advisory Council of the School of Law, and on the Executive Committee of that body, and has been involved in numerous other committees and efforts to assist the School of Law and its students.
FI&C associate, Julie Zink, has accepted an invitation to join the Advisory Board for the Paralegal Program at Sinclair Community College. Before she attended law school, Julie was a 1994 graduate of Sinclair's Paralegal Program. Julie is looking forward to serving her three-year term on the Advisory Board, which is composed of judges, practicing lawyers, paralegals, paralegal managers, faculty, administrators, and other members of the Dayton community. Julie is also co-developing a course on attorney-client privilege and work product protection that will be offered to paralegal students this summer.
Michele A. Murphy successfully completed the Cincinnati Academy of Leadership for Lawyers ("CALL") Class IX. She was admitted as a Fellow to the Academy on May 19, 2005. CALL, sponsored by the Cincinnati Bar Association and the University of Cincinnati College of Law, promotes leadership, professionalism, and the highest ethical standards among practicing lawyers. Michele was one of twenty-six lawyers from the region selected to participate in CALL Class IX.
Chad Burton was recently appointed to the Board of Directors for a non-profit organization called the Miami Valley Teen Coalition. The mission statement for the Coalition is: "To build a community responsive to the needs of teens through advocacy and education." The Coalition is a network of about thirty organizations from the Dayton-area that share this common goal, including the YWCA of Dayton, Planned Parenthood Southwest Ohio, Dayton Urban League, and Dayton Public Schools, among others.
