In October 2005, an arbitrator issued a favorable decision in a confidential arbitration on behalf of a long-time client.
The plaintiff had sought approximately $1 million in damages for two alleged violations of a confidentiality agreement. After a trial, however, the arbitrator held that the client, although responsible for one of the two alleged disclosures, was not liable for any damages other than fees and costs. Marty Foos and Michele Murphy handled this case.
On October 21, 2005, Judge Dennis J. Langer of the Montgomery County Court of Common Pleas issued a favorable decision on a class certification motion.
The case involved a high-profile class action brought on behalf of Miamisburg residents who had been evacuated from their homes following an explosion in 2003. The issue before the Court was whether or not a class should be certified. Although the Court partially certified a class, its decision significantly limited the scope and breadth of that class. It also divided trial into four phases so as to enhance the fairness to the parties and to comply with Ohio's recent tort reforms. Tom Kraemer and Marty Foos are handling this case.
