  • FI&C completed another very successful recruiting year.

  • Ron Raether published an article titled "Security Before and After a Data Breach," in the Business Law Today, November/December 2006.
  • Erin Rhinehart recently published an article in The Federal Lawyer, which is the nationally-circulated professional magazine of the Federal Bar Association, and is dedicated to the interests of practitioners of federal law.
  • Eli Kiefaber and Brian Wright wrote an article entitled "A Call for Action: Federal Anti-Pretexting Law Needed," which was published in the October 2006 edition of LexisNexis' Mealey's Privacy Reporter.
  • Ron Raether, Katie Wahl and Brian Wright were presenters at a one-day seminar in Cincinnati, Ohio on November 1, 2006, that was sponsored by the National Business Institute.

November 2006

  • Faruki Ireland & Cox P.L.L. Launches FI&C University
  • Our firm has received one award, and is a finalist for another.
  • In addition, our firm has been nominated for the 2006 Business of the Year, sponsored by the Dayton Business Journal, in the category of Community Supporter of the Year, and is one of the finalists for that award, to be announced next month.
  • Jeff Ireland and Laura Sanom made a presentation at the Ohio State Bar Associations' 40th Annual Institute Symposium.
  • Jeff Cox will be presenting two CLE webcasts in December for NBI.
  • Ron Raether and Brian Wright wrote an article entitled "Sarbanes-Oxley & Internal Controls: The Not So Hidden Implications for Information Technology and Information Security," which was published in the September 2006 edition of LexisNexis Mealey's Privacy Reports.

October 2006

  • FI&C is now 3-0 before the Supreme Court of Ohio since 2000.
  • On September 29, 2006, the U.S. District Court for the Southern District of Ohio granted a Motion to Dismiss filed by FI&C on behalf of a brokerage firm and several independent brokers in a nationwide securities action relating to viaticals.
  • FI&C was awarded a Dayton Business Journal Health Care Hero award.
  • Jeff Ireland completed his two-year term as the Chairman of The Salvation Army Advisory Board in Dayton.

September 2006

  • Charlie Faruki has again this year been selected by his peers to be included in the upcoming 2007 edition of the Best Lawyers in America, in the categories of Commercial Litigation, Energy Law, and White-Collar Criminal Defense.
  • Ron Raether and Brian Wright were presenters at a one-day seminar in Cincinnati, Ohio on August 14, 2006 that was sponsored by the National Business Institute.
  • FI&C welcomes two new associates this month.
  • The firm is once again in the midst of the annual fall recruiting process.
  • Rebecca Owen recently completed the Accenture Chicago Triathlon as a member of the Leukemia and Lymphoma Team in Training.
  • FI&C associate Holt Hedrick has been tapped for a leadership position with the Indiana University Alumni Association, Dayton Chapter.

August 2006

  • An animal rights group made a public records request for research studies conducted by one of our firm's clients at a major university.
  • In July Charlie Faruki was a panelist in the Health Care Forum sponsored by the Dayton Business Journal and by Anthem Blue Cross/Blue Shield.
  • Don Burton's article, "The Metes and Bounds of the Defendant Class Action in Patent Cases," has been published in the Spring 2006 issue of the Review of Intellectual Property Law of The John Marshall Law School.
  • FI&C Associates John Fischer and Eli Kiefaber have published An Overview of the Driver's Privacy Protection Act of 1994 in the July 2006 edition of the LexisNexis Mealey's Privacy Reports.
  • Tim Pepper has been elected Chairman of the Board of Trustees of the Dayton Society of Natural History, Inc.
  • Erin Rhinehart, a second-year associate with the firm, was recently appointed as vice-chair of the Bar Briefs Editorial Board.

July 2006

  • Ron Raether, Marty Foos, and Brian Wright were selected as Ohio Rising Star Super Lawyers for 2006.
  • Ron Raether co-chaired the Sixteenth Annual Seminar held by the University of Dayton School of Law regarding Significant Developments in Computer and Cyberspace Law on June 9, 2006.
  • An article by Don Burton titled "The Metes and Bounds of the of the Defendant Class Action in Patent Cases" was recently published
  • An FI&C victory makes national news.
  • Chad Burton has been appointed as the Chair of the Young Lawyers Committee for the Dayton Bar Association.

June 2006

  • In a case handled by Bob Bartlett and Tim Pepper, Ohio's Second District Court of Appeals ruled in favor of FI&C client Dayton Newspapers, Inc., and ordered the City of Troy to release public records pertaining to its undercover investigation of a sexually-oriented business.
  • The U.S. District Court for the Southern District of Ohio has granted a Motion to Remand filed by FI&C on behalf of an international air freight service provider.
  • Brad Anderson and Chad Burton recently negotiated a favorable settlement on behalf of an FI&C client in a matter pending before the Trademark Trial and Appeal Board of the United States Patent and Trademark Office.
  • In May, Charlie Faruki was formally welcomed into membership in the American Board of Trial Advocates...
  • FI&C associate, Brian Wright, has returned to the firm after participating in the firm's externship program with the Montgomery County Public Defender's Office.
  • Katie Miltner, an FI&C associate, was recently elected to serve on the Hanover College Alumni Association Board of Directors for a three-year term beginning in August, 2006.

May 2006

  • FI&C has been named the first recipient of the Access to Justice's Community Impact Award.
  • An article written by FI&C associate Lynn Posey was published in the March edition of the Journal of Internet Law.
  • Andrew J. Reitz, an associate at FI&C, was recently elected as an "At-Large Steering Committee Member" of Generation Dayton.

April 2006

  • On March 24, 2006, the U. S. District Court for the Southern District of Ohio granted a motion to compel arbitration that was filed in a construction case being handled by Jeff Ireland and Brad Anderson.
  • In a case handled by FI&C associate Tim Pepper, the U.S. District Court for the Southern District of Ohio granted summary judgment to FI&C client Hamilton Beach/Proctor-Silex, Inc.
  • FI&C associate Tim Pepper has been selected by the Dayton Business Journal as a "40 Under 40" Award winner for 2006.
  • Charlie Faruki was selected for the Lawdragon 500 Leading Litigators in America.
  • On March 13, 2006, Jeff Cox was a panelist for a public roundtable forum convened by the Dayton Daily News as part of their "2006 Sunshine Week" activities to discuss the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and its effect on public safety, health care, public information and privacy rights.
  • An article entitled, "From Civil to Criminal -- Overnight," written by Andrew J. Reitz, an associate at FI&C, was published in the March/April 2006 edition of the Ohio Lawyer.
  • FI&C associate John Fischer and FI&C Systems Manager Brenda Hinkle presented the firm's LexisNexis Total Search Case Study to attorneys and law firm information technology professionals from across the country at the LexisNexis Total Search Summit in Chicago, Illinois on March 9, 2006.

March 2006
  • In a matter handled by Charlie Faruki and Jeff Sharkey for The Dayton Power and Light Company ("DP&L"), the Public Utilities Commission of Ohio ("PUCO") denied applications for rehearing filed by The Office of the Ohio Consumers' Counsel ("OCC") and Ohio Partners for Affordable Energy ("OPAE").
  • In another matter handled by Jeff Sharkey for DP&L before the PUCO, the PUCO approved the recovery of $16 million that DP&L invested in its billing system.
  • FI&C Associates John Fischer, Erin Rhinehart and Chad Burton again assisted the Chaminade-Julienne High School mock trial team to a second-place finish at the Ohio High School Mock Trial District Competition held at the Montgomery County Courthouse in February.

February 2006
  • In class action litigation arising from a chemical plant explosion, FI&C lawyers recently won a summary judgment against the lead plaintiffs' claims for emotional distress.
  • Jeff Sharkey successfully defended a motion in which a plaintiff sought to have an FI&C client held in contempt of court.
  • Jeff Sharkey, Nick Smith and Erin Bair won a motion to disqualify opposing counsel in a case pending in Hamilton County Common Pleas Court.
  • In January, Brad Anderson was elected President of Health Partners of Miami County

January 2006
  • The Dayton Business Journal published its annual Book of Lists on December 16, 2005.
  • Charlie Faruki, Jeff Ireland, Jeff Cox and Bob Bartlett have again been selected by their peers as SuperLawyers.
  • In a case handled by FI&C, the Supreme Court of Ohio denied a motion for a stay that was filed by The Office of the Ohio Consumers' Counsel ("OCC").
  • In a case handled by FI&C attorney Tim Pepper, the Supreme Court of Ohio ordered a financial planner to stop practicing law without a license and levied a $10,000 fine.
  • Jeff Cox has been elected to the Board of Directors of the Miami Valley Venture Association for 2006.
  • Jeff Sharkey has been elected to the Board of Directors for the Dayton Ronald McDonald House for a three-year term.
