FI&C completed another very successful recruiting year.
FI&C will welcome the following new associates in the fall of 2007: Bruke Sullivan (Washington University School of Law; University of North Carolina at Chapel Hill , B.A.), Lindsay Potrafke (Marquette University Law School; Saint Louis University, B.A.), and Tiffany Austin (University of Notre Dame Law School; Spelman College, B.A.). We will also welcome the following summer associates for the summer of 2007: Ryan Shafer (University of Notre Dame Law School; University of Dayton, B.A.) and Mike Zbawiony (University of Dayton School of Law; Michigan State University, B.A.). We are very excited that Bruke, Lindsay, Tiffany, Ryan and Mike have decided to join us!

Jeff Ireland will be conducting three seminars in December.
His first seminar is titled "Litigating to Win Through Advanced Trial Advocacy" and will be conducted in Cincinnati on December 7, 2006, through the National Business Institute. Jeff is also conducting a seminar titled "New Lawyer's Training (Litigation)" in Columbus on December 15, 2006, through the Ohio State Bar Association. Finally, Jeff is conducting a seminar titled "Appellate Practice" on December 12, 2006 through the Dayton Bar Association.

Charlie Faruki was invited to speak to the Corporate Counsel Committee of the Dayton Bar Association.
His topic, "What To Do (and Not Do) When The Suit or Notice Arrives; Best Practices For The In-House Lawyer," focused on practical advice for in-house counsel who first receive a suit or subpoena. It included a checklist of the points, questions, and action items that are important at the inception of a matter. Charlie also discussed recent developments in attorney/client privilege, the work product doctrine, and electronic discovery.

Ron Raether published an article titled "Security Before and After a Data Breach," in the Business Law Today, November/December 2006.
Ron's article provides practical advice on dealing with data security breaches. From describing applicable law to walking through the appropriate responsive steps, Ron shares his experience in helping companies navigate through a potential crisis. Erin Rhinehart recently published an article in The Federal Lawyer, which is the nationally-circulated professional magazine of the Federal Bar Association, and is dedicated to the interests of practitioners of federal law.
Her article "Pleading for Particularity" discusses the waning applicability of the group pleading doctrine, which is often used by plaintiffs when pleading claims of securities fraud against multiple defendants for alleged violations of section 10(b) of the Securities Exchange Act of 1934 and Rule 10b-5. Her article appears in the November/December issue of The Federal Lawyer.

Eli Kiefaber and Brian Wright wrote an article entitled "A Call for Action: Federal Anti-Pretexting Law Needed," which was published in the October 2006 edition of LexisNexis' Mealey's Privacy Reporter.
Eli and Brian discuss the inadequacies of existing protections against the use of pretexting to gain unauthorized access to telephone records. Using the recent revelations at Hewlett-Packard Company, Eli and Brian demonstrate that current federal law would not clearly prohibit the H-P investigators' ethically questionable conduct. In addition, Eli and Brian explain how securing convictions of the persons charged under California law is anything but certain, and that newly enacted state laws are insufficient to provide protections needed. Ron Raether, Katie Wahl and Brian Wright were presenters at a one-day seminar in Cincinnati, Ohio on November 1, 2006, that was sponsored by the National Business Institute.
The seminar, titled "E-Discovery and Computer Forensics: Strategies for Success," focused on teaching legal professionals methods for the collection of electronic evidence and use of computer forensics.
