In a case handled by Bob Bartlett and Tim Pepper, Ohio's Second District Court of Appeals ruled in favor of FI&C client Dayton Newspapers, Inc., and ordered the City of Troy to release public records pertaining to its undercover investigation of a sexually-oriented business.
The court ruled on May 16, 2006, that the investigative records at issue, which described Troy's unauthorized use of a deceased person's identity to subscribe to a pornographic website, must be disclosed pursuant to Ohio's Public Records Act. FI&C frequently represents media outlets on First Amendment, public records, and open government matters.
The U.S. District Court for the Southern District of Ohio has granted a Motion to Remand filed by FI&C on behalf of an international air freight service provider.
In a case handled by Tim Pepper, the court ruled on May 25, 2006, that the opposing party's removal of the case from state court to District Court in Cincinnati was improper. The court remanded the case back to the state court where it was originally filed, and further awarded FI&C's client its attorney's fees related to the improper removal and remand.
Brad Anderson and Chad Burton recently negotiated a favorable settlement on behalf of an FI&C client in a matter pending before the Trademark Trial and Appeal Board of the United States Patent and Trademark Office.
The settlement prevents the opposing company from registering our client's trademark in a manner that would harm the client's business. The settlement was reached without resort to protracted litigation, and it protects the client's valuable trademark in a competitive e-commerce environment.
In May, Charlie Faruki was formally welcomed into membership in the American Board of Trial Advocates,
an organization of lawyers dedicated to fostering improvement in the ethical and technical standards of practice in advocacy. ABOTA is not a bar association, but rather an organization into which a trial lawyer may be invited because he or she has shown superior skills in a significant number of jury trials, and a level of integrity, ethics and professionalism that is at the top of the profession.
FI&C associate, Brian Wright, has returned to the firm after participating in the firm's externship program with the Montgomery County Public Defender's Office.
During the externship, Brian tried two felony jury trials, and handled several preliminary hearings, sentencing hearings, suppression hearings, arraignments, extradition hearings, status conferences, and scheduling conferences. FI&C's partnership with the Montgomery County Public Defender's Office is part of the firm's commitment to providing pro bono services and to teaching junior lawyers how to try cases, manage clients, argue motions, and develop general trial skills. The externship program provides significant training opportunities for the firm's associates as it provides them with hands-on jury trial experience early in their legal careers.
Katie Miltner, an FI&C associate, was recently elected to serve on the Hanover College Alumni Association Board of Directors for a three-year term beginning in August, 2006.
The Board of Directors provides advice to the college and cultivates relationships between alumni and the College by developing, promoting, and facilitating alumni-supported programs that enhance the stature and traditions of Hanover College. The Board focuses its efforts in the areas of educational programming, development, recruitment and career placement.
