In a matter handled by Charlie Faruki and Jeff Sharkey for The Dayton Power and Light Company ("DP&L"), the Public Utilities Commission of Ohio ("PUCO") denied applications for rehearing filed by The Office of the Ohio Consumers' Counsel ("OCC") and Ohio Partners for Affordable Energy ("OPAE").
DP&L and most of the parties to the case entered into a Stipulation and Recommendation ("Stipulation") that establishes electric generation rates for DP&L's customers through 2010. After a trial, and over objections made by OCC and OPAE, the Commission approved the Stipulation, ruling that it would benefit customers and the public interest. OCC and OPAE filed applications for rehearing, and DP&L, in a memorandum prepared by Charlie and Jeff, opposed the applications for rehearing. On February 22, 2006, the PUCO agreed with DP&L's arguments and denied the applications for rehearing.

In another matter handled by Jeff Sharkey for DP&L before the PUCO, the PUCO approved the recovery of $16 million that DP&L invested in its billing system.
OCC and OPAE opposed DP&L's request to recover that investment. After an evidentiary hearing and briefing handled by Jeff, the PUCO agreed with DP&L's arguments and approved the recovery of the full $16 million requested by DP&L.

FI&C Associates John Fischer, Erin Rhinehart and Chad Burton again assisted the Chaminade-Julienne High School mock trial team to a second-place finish at the Ohio High School Mock Trial District Competition held at the Montgomery County Courthouse in February.
The CJ team will now advance to State finals held in Columbus in March. A CJ team has advanced to the State rounds three of the last four years that FI&C attorneys have worked with the school. Sponsored by the Ohio Center for Law-Related Education, this year's mock trial competition required the students to portray lawyers and witnesses in a criminal proceeding.
