Jeff Cox, Ron Raether and Tom Kraemer led an FI&C team that successfully concluded a civil investigation of potential unauthorized access by computer hackers attempting to access consumers' personal information, the resolution of which was recently announced by the Federal Trade Commission.
FI&C partnered with a large Washington, D.C.-based law firm to resolve a multi-year investigation, representing one of the world's leading publication and information aggregators. The investigation concluded in a negotiated consent order settlement which will subject the Company to a series of external audits, but which imposes no financial penalties whatsoever.
Ron Raether, Jeff Sharkey and John Fischer successfully defended a motion for class certification that was filed in a case against one of FI&C's clients.
The client is a national retailer, and the Plaintiff alleged that it violated the Fair and Accurate Transactions Act (which amended the Fair Credit Reporting Act) by printing the credit card expiration date on receipts issued to customers. The Court agreed with FI&C's arguments that a class should not be certified since it would not be manageable and would impose a risk of creating a ruinous liability for FI&C's client.
Ron Raether and Eric Voigt successfully defended against a Motion to Remand filed by Plaintiff.
Ron and Eric argued that the parties were citizens of different states and, thus, the District Court for the Western District of Texas had diversity jurisdiction over Plaintiff's claims for breach of an employment handbook and defamation. The District Court concluded that Defendants properly removed the action to federal court based on diversity jurisdiction.
The Corporate Counsel Edition of the Super Lawyers 2008 magazine has just been published, listing Ohio's Top Attorneys in Business Litigation.

On March 27, 2008, Marty Foos presented two sections of a National Business Institute continuing legal education seminar titled, "How to Win Your First Civil Trial."

Faruki Ireland and Cox is the first law firm to reach 100% participation in The Ohio State University Moritz College of Law "Law School Challenge."
The College challenged alumni in firms with five or more Moritz graduates to participate in the college's Annual Giving Program. Law firms and corporations throughout the state have participated in the challenge.
