  • On September 17, 2008, the U.S. District Court for the Southern District of Ohio (Dayton) ruled on a motion to dismiss in a securities case being defended by Jeff Ireland, Marty Foos, and Erin Rhinehart.
  • On September 22, 2008, U.S. District Court for the Southern District of Ohio (Dayton) confirmed a Second Partial Final Award.
  • After an evidentiary hearing and briefing, the Montgomery County Common Pleas Court denied a petition by a local municipality to appropriate via eminent domain street lights that are owned by FI&C's client.
  • After several years, the federal government closed a criminal investigation of one of the firms' clients concerning whether or not the Clean Air Act was violated.
  • In an action pending in the District Court for the Western District of Texas, Ron Raether, Angela Sinkovits and Eric Voigt prevailed on a motion to dismiss, which the Court converted to a motion for summary judgment.
  • Charlie Faruki has again been selected by his peers for inclusion in the 2009 edition of The Best Lawyers in America.
  • On September 24, 2008, Jeff Ireland spoke at an NBI seminar "May It Please the Court Effective Case Presentation at Trial."

  • Ron Raether published an article in the Dayton Business Journal that discussed privacy laws.
  • In response to a call to action from Ohio Supreme Court Chief Justice Moyer, Marty Foos and Rebecca Owen participated in the Foreclosure Legal Assistance Group (FLAG) and successfully represented a foreclosure defendant pro bono.
  • FI&C's 2008 fall associate class began August 25, 2008.

June 2008

  • On May 30, 2008, the U.S. District Court in Camden, New Jersey preliminarily approved a $24 million settlement of more than 120 class actions in the United States and Canada relating to the alleged contamination of pet food.
  • In an action in the Northern District of Ohio involving a declaratory judgment action filed by the firm on behalf of a client that was the subject of an indemnity claim by a firm which had lost a patent infringement action, in which judgment had been entered for over $34 million, Charlie Faruki and Don Burton succeeded in defeating a motion to dismiss, so that the action can proceed.
  • Bob Bartlett, Jeff Sharkey and Andy Reitz prevailed in a motion for summary judgment in a defamation action pending in Montgomery County Common Pleas Court.
  • On May 12, 2008, FI&C welcomed Jade Smarda and Kelly Rethman as summer associates.
  • Charlie Faruki spoke at two CLE programs within the past month.

  • FI&C Associate Angela Sinkovits successfully represented a client in an application for guardianship against a competing applicant.

April 2008

  • Jeff Cox, Ron Raether and Tom Kraemer led an FI&C team that successfully concluded a civil investigation of potential unauthorized access by computer hackers attempting to access consumers' personal information, the resolution of which was recently announced by the Federal Trade Commission.
  • Ron Raether, Jeff Sharkey and John Fischer successfully defended a motion for class certification that was filed in a case against one of FI&C's clients.
  • Ron Raether and Eric Voigt successfully defended against a Motion to Remand filed by Plaintiff.
  • The Corporate Counsel Edition of the Super Lawyers 2008 magazine has just been published, listing Ohio's Top Attorneys in Business Litigation.
  • On March 27, 2008, Marty Foos presented two sections of a National Business Institute continuing legal education seminar titled, "How to Win Your First Civil Trial."
  • Faruki Ireland and Cox is the first law firm to reach 100% participation in The Ohio State University Moritz College of Law "Law School Challenge."

  • Representing a manufacturer of underground piping systems, the firm recently won an arbitration award for its client in an amount exceeding $1.82 million.
  • Jeff Ireland and Jacqueline Brown obtained a successful result for a Fortune 500 client in an employment class action based upon allegations of age and race discrimination.
  • Marty Foos and Katie Miltner recently won dismissal of an Arizona lawsuit brought against local clients.
  • Jeff Ireland spoke at the Winter Conference meeting of the Ohio City/County Management Association as part of a presentation titled "Looking Ahead: The Economy and the Future of Ohio."

February 2008

  • Brian Wright published an article titled "Fighting Dishonest Ads Isn't Always Expensive" in the January 11, 2008 edition of the Dayton Business Journal.
  • Eric Voigt, an associate at FI&C, has been published in the 2007 issue of the Cleveland State Law Review (55 Clev. St. L. Rev. 339).
  • Katie Wahl was elected Vice-President of the Tipp City Public Library Board of Trustees at its annual meeting in January.

January 2008

  • In its December 9, 2007 edition, the Dayton Daily News reported that Faruki Ireland & Cox was recently ranked second in Ohio in litigation among Ohio law firms.

  • In a case involving an explosion at one of the firm's clients, a local chemical company, the firm recently won the dismissal of an appeal taken by the opposing party.
  • FI&C completed another very successful recruiting year.
