Ron Raether, Katie Wahl, and Trey Pauley prevailed on a motion to dismiss a complaint pending in Washington Superior Court.   
While on the face of the complaint it appeared that Plaintiff had satisfied the statute of limitations, FI&C located a little known procedural requirement available under Washington law.  Relying on this creative approach, FI&C argued that the statute of limitations on the alleged defamation claim expired prior to proper service on its client.  The Court agreed, and the complaint was dismissed.

On March 3, 2009, FI&C attorneys Bob Bartlett, Jeff Sharkey, Andy Reitz and Trey Pauley prevailed on a motion for summary judgment on behalf of an FI&C media client.
FI&C argued in the motion that the story at issue was true, and the Court agreed.

FI&C is representing a college professor against one of Ohio's largest state Universities.
The University proposed the dismissal of the firm's client and brought the case before a Panel composed of seven faculty members. On March 5, 2009, the Panel decided the case against the University and in favor of the firm's client, finding that the University had not proven sufficient grounds for dismissal of the Professor. FI&C Partner, Marty Foos, represented the client at the hearing.

Brian Wright spoke at a March 6, 2009 seminar about presenting electronic evidence, which was sponsored by the Dayton Bar Association.
The seminar, entitled "Technology: In Your Brief, Your Briefcase and Your Pocket...," focused on the presentation of electronic information throughout the trial process, from discovery and depositions through jury selection and opening and closing arguments, so that information can be organized and available for use throughout trial. Such tools include Summation to manage documents and depositions, videotaping of depositions and using Sanction for impeachment purposes during cross-examination, as well as PowerPoint and other tools that provide visual guidance to juries during opening and closing statements..

On March 20, 2009, the Dayton Daily News ran an article featuring two FI&C associates, Cori Stirling and Trey Pauley, for their efforts as legal advisors of the DECA (Dayton Early College Academy) mock trial team.  
This year, twelve DECA students joined the mock trial team and advanced past the district-level competition, won the regional-level competition and made their way to Columbus to compete in the state-level competition.  The article highlights the valiant efforts of the students.  Although the article characterizes the events as a "Cinderella story," the hard work and dedication of the students are the real reasons that DECA advanced in the competition.
