FI&C News May 2010

In May Charlie Faruki was a speaker at the Annual Convention of the Ohio State Bar Association. The program was titled "Welcome to Federal Court: It's Different; an Introduction to Practice in Ohio's Federal Trial Courts." The program was sponsored by the OSBA's Federal Courts and Practice Committee, of which Charlie is the immediate past-chair. He was a speaker at the program, on the topics of "What to do if Your Case is Removed to Federal Court?" and "What to Expect in Federal Court: How Different is it?" He was also the moderator of a panel consisting of District Judges and Magistrate Judges from the Northern and Southern Districts of Ohio, who discussed a wide array of topics ranging from jurisdiction and removal to case management, to discovery, to motion practice.

In April Charlie Faruki spoke to the Dayton Intellectual Property Law Association; he conducted a CLE program titled Recent Patent Litigation Developments.  Topics included the evolving patent exhaustion doctrine, and patent misuse.

On April 23, 2010, the Dayton Business Journal published an article written by associate Erin E. Rhinehart regarding the effect of the recent health care reform law on Ohio's pregnancy discrimination laws. Among the myriad of health care-related provisions, the Patient Protection and Affordable Care Act amends the Fair Labor Standards Act of 1938 to require employers to provide reasonable, unpaid break time and a suitable place, other than a bathroom, for employees to express breast milk for their nursing child. The article cautions Ohio's employers that the recent health care reform law calls into question the continued vitality of decisions of the Ohio judiciary favoring employers' decisions to terminate nursing mothers for taking too many breaks during working hours, and suggests that Ohio's pregnancy discrimination laws may be amended or interpreted to better protect pregnant and nursing women in the workplace.
