The United States District Court for the Southern District of Ohio granted a motion to exclude an $84 million damages claim that was filed by Charlie Faruki, Jeff Sharkey and Don Burton.  The $84 million calculation was submitted by Plaintiff's expert after the court-imposed deadline to serve expert reports. FI&C persuaded the Court that the calculation was not a supplement to a prior opinion, and that the delay in providing the calculation was not harmless.

Jade Smarda has been asked to serve as mentor to students participating in the University of Dayton School of Law's new Leadership Honors Program (LHP).  The LHP is for UDSL's top applicants, who complete a specially-designed Graduated Leadership Sequence in addition to UDSL's standard curriculum.  In the first year, LHP students will engage with national and international experts in law, governance and business in the Honors Roundtable Series to be chaired by former Ohio Governor Robert Taft.  In the second year, students will take part in an innovative Leadership for Lawyers seminar at the University of Dayton's prestigious Center for Leadership.  Finally, in the next-to-last semester, students will create their Leadership Legacy by working together on a project to help transform a community institution. A 2009 graduate of UDSL, Jade has remained actively involved with programming at her alma mater, and is excited about the opportunity to help mentor the legal profession's next generation of leaders.

Michael Mayer and Jade Smarda will be presenters at an upcoming Continuing Legal Education program titled "Litigation Basics."  The program will take place on Thursday, September 22 at the Ohio State Bar Association, 1700 Lake Shore Drive in Columbus.  Michael and Jade will be speaking on the topics of Settlement and Alternative Dispute Resolution.  For more information, see https://downloads.ohiobar.org/CLE/2016/16-071.pdf.

From July 18th – 28th, summer clerks in Cincinnati participated in the third annual mock trial program organized by Judge Michael R. Barrett of the Southern District of Ohio, and Dan Donnellon of Bingham Greenebaum Doll.  Stephen Weigand, Jason Palmer, and Jennifer Dollard volunteered as jurors, which consisted of observing a bench trial from opening to closing, deliberating with lawyers and non-lawyers alike, and presenting a verdict and comments to the law student participants.   FI&C congratulates all the participants on their impressive performances.

This month, the American Bar Association's tyl periodical published Jennifer Dollard's latest article, "The Music Industry vs. the Internet and Congress."  Jenn's article discussed the latest development in the music industry's battle for reform of the Digital Millennium Copyright Act:  an open letter to Congress, signed by nearly 200 of the biggest names in music – including Taylor Swift, Sir Paul McCartney, and Lady Gaga.
