Representative matters include trade secret and intellectual property arbitrations, defense of consumer and product class actions, Lanham Act and false advertising disputes, and trade secret and restrictive covenant litigation.

  • Trade Secrets and Restrictive Covenants Litigation:  Lead counsel in multiple matters involving trade secrets, noncompete and nonsolicit disputes, and emergency injunctive relief, including temporary restraining orders and preliminary injunction proceedings.
  • Trade Secret and Copyright Arbitration:  Defense of a legal information and analytics company in a multiday arbitration involving trade secret and copyright claims (American Arbitration Association, Dayton).
  • Software and Copyright Litigation:  Representation of defense contractors in breach of contract and copyright litigation (S.D. Ohio; Greene County, Ohio).
  • Employment Litigation:  Defense of a national healthcare diagnostics company in employment discrimination litigation (S.D. Ohio).
  • Trademark and Domain Name Dispute:  Representation of a global foodservice equipment manufacturer in a trademark and domain name dispute (National Arbitration Forum).
  • Shareholder Litigation:  Defended a large privately held corporation in a dispute with a minority shareholder over a request to inspect the company's books and records (Warren County, Ohio).  Defended the current owners of a privately held corporation in a dispute with a former shareholder regarding alleged payments under redemption agreements (Greene County, Ohio).
  • Class Action Defense, Consumer and Product:  Defense work for a multinational consumer products company in consumer and product matters, including appellate and trial-court proceedings (6th Cir., S.D. Ohio).  Defended a fitness equipment manufacturer in a consumer class action alleging false advertising regarding treadmill motors (6th Cir., S.D. Ohio).
  • Mass Consumer Recall Litigation:  Representation of a pet food manufacturer in multidistrict litigation arising from product claims, including MDL proceedings (3rd Cir., D. New Jersey).
  • False Advertising and Competitor Disputes:  Representation of major consumer brands in National Advertising Division proceedings involving advertising substantiation and comparative claims.
  • FCRA class allegations:  Defense of a consumer reporting agency in Fair Credit Reporting Act dispute (D. Maryland).
  • Product Liability Defense:  Defense of manufacturers in product liability matters in federal and state courts, including subrogation and personal injury claims.
  • Patent Litigation:  Defended a foodservice equipment manufacturer in a patent dispute (S.D. Ohio) and in an inter partes review before the U.S. Patent Trial and Appeal Board (PTAB), resulting in a complete victory in the IPR and voluntary dismissal with prejudice of the related district court matter.
  • IP and Unfair Competition Dispute:  Defense of a company in an intellectual property dispute resolved favorably after a multiday preliminary injunction hearing (Hamilton County, Ohio).
